From March 23, 2020 to April 22, 2020, New York Governor Andrew Cuomo has issued an Executive Order (Number 202.10). This grants immunity to licensed healthcare workers who are providing care as a result of the current public health emergency regarding the COVID-19 pandemic.
The purpose of this executive order is to ensure adequate hospital bed capacity, supplies, and providers for New York State. This will help both patients affected with COVID-19 and patients in other situations who need help.
Governor Cuomo has granted immunities to licensed healthcare workers who:
In support of New York State’s response to COVID-19, provide medical services
Act reasonably and with good faith
Without current registration, may come out of retirement to provide medical care
Travel from another state to New York to contribute and help
The specific types of immunities are as follow:
-Immunity from Civil Liability for Injury or Death
-Immunity from Recordkeeping Liability
-Immunity from Civil and Criminal Penalties for Lack of Physician Supervision
-Immunity from Civil and Criminal Penalties for Practicing in New York State Without a New York State License
-Immunity from Civil and Criminal Penalties for Practicing in New York State without Current Registration
